LATIMUS Terms of Service

These Terms of Service (“Terms”) govern your use of the services provided by LATIMUS (Learning and Teaching in Music), a UK-based cooperative providing music education and related services (“we”, “us”, “our”).

By accessing or using any LATIMUS service, platform, course, event or website, whether online or in person, you (“you”, “your”, “the user”) agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

1. Definitions

  • “Services” means any music education, classes, workshops, resources, memberships, downloads, or consultancy offered by LATIMUS.
  • “Platform” includes all LATIMUS-owned websites, digital products, live or recorded media, and any hosted learning environments.
  • “Client” means any individual, parent/guardian, school, or organisation purchasing services from LATIMUS.

2. Eligibility and Conduct

  • You must be at least 18 years old to register for paid services unless a parent/guardian contracts on your behalf.
  • You agree to provide accurate and complete information when registering or booking services.
  • LATIMUS reserves the right to refuse or terminate service to any user who breaches these Terms or engages in conduct deemed abusive, unlawful, or harmful.

3. Use of Services

All services, whether digital or in-person, are for your personal, non-commercial use unless otherwise stated in writing. You may not:

  • Copy, distribute, modify, or exploit any of our materials or intellectual property without prior written consent;
  • Record or distribute our live sessions or video content without permission;
  • Interfere with or disrupt our platforms, systems, or tutors.

4. Fees and Payment

  • All fees must be paid in full in advance unless an agreed instalment plan is in place.
  • We reserve the right to change pricing at any time with reasonable notice.
  • VAT (if applicable) will be added to charges as required by UK law.
  • LATIMUS is not liable for bank charges, currency conversion fees, or delays due to third-party payment processors.

5. Cancellations and Refunds

Please refer to our Refunds and Returns Policy for full details on your rights and our obligations regarding cancellations, refunds, and exchanges.

  • Clients booking tuition are entitled to a 14-day cooling-off period for cancellations under the Consumer Contracts Regulations, provided no service has commenced.
  • Sessions missed without notice or cancellations with insufficient notice may not be refunded unless under exceptional circumstances.

6. Intellectual Property

All content, including lesson materials, compositions, videos, course structures, branding, and digital resources, remain the property of LATIMUS or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use materials for your own educational purposes only.

7. Code of Conduct

All users are expected to:

  • Treat tutors, participants, and staff with respect and professionalism;
  • Follow appropriate safeguarding and health & safety procedures;
  • Avoid discriminatory, offensive, or illegal behaviour at all times.

Failure to adhere to this Code may result in immediate suspension or termination of services, with no refund.

8. Data Protection and Privacy

We comply with the UK General Data Protection Regulation (UK GDPR). For details on how we collect, store and use your data, please see our Privacy Policy.

By using our services, you consent to the collection and lawful use of your personal data as outlined in that policy.

9. Limitation of Liability

To the extent permitted by law, LATIMUS shall not be liable for:

  • Any indirect, incidental, or consequential loss arising from your use of our services;
  • Any interruption or failure in online access due to factors beyond our control;
  • Any injury, loss, or damage resulting from activities undertaken as part of our classes or services, unless caused by our proven negligence.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

10. Termination

LATIMUS reserves the right to suspend or terminate your access to any service if you breach these Terms, misuse the service, or if payment is overdue. In such cases, no refund will be issued unless required by law.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We reserve the right to amend these Terms at any time. Updated Terms will be posted on our website and are effective immediately upon publication. Continued use of our services after changes are made constitutes your acceptance of the new Terms.
